We often hear in the news that deputies to the National People’s Congress converge on Beijing to discuss and deliberate national and legislative affairs. Then, how is the National People’s Congress formed? And what are its powers and functions?
The National People’s Congress is the highest state organ of power.
According to the Constitution, the main powers of the National People’s Congress include the legislative power, the power of personnel appointment and removal, power of decision and power of supervision.
Its functions include amending the Constitution and supervising the enforcement of the Constitution, enacting basic national laws, electing and removing from office leaders of the state organs, including electing the President and Vice President.
Deciding, based on nominations, the candidate for the Premier of the State Council and candidates for other members of the State Council, electing the chairman of the Central Military Commission.
Deciding, based on nominations, the candidates for other members of the Central Military Commission, and electing the president of the Supreme People’s Court and the Procurator General of the Supreme People’s Procuratorate.
Reviewing and approving the plans for national economic and social development and the report on its implementation.
Deciding other important affairs of the State.
The permanent organ of the National People’s Congress is its Standing Committee. When the National People’s Congress is out of session, its Standing Committee exercises the powers as empowered by the Constitution and laws, and performs the functions of the National People’s Congress. The Standing Committee is composed of the chairperson, several vice-chairpersons, the secretary general and members.
The Constitution stipulates, the People’s Republic of China applies the National People’s Congress system, and all power belongs to the people. The National People’s Congress and local people’s congresses at all levels are the bodies through which the people exercise state power. This conforms to the socialist system.
The people, by the means of democratic elections, elect their deputies to form the
National People’s Congress and the local people’s congresses at all levels, and to
exercise the state powers.
Each National People’s Congress shall have a term of five years and, in general, a plenary session of the National People’s Congress is held once every year.
